Terms of Service

By creating an account or using Mahl ('the Service'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and MAHL. APP, a registered business based in Adelaide, South Australia, Australia (ABN 89 646 767 162).

We reserve the right to update these Terms at any time. Continued use of the Service after updates are posted constitutes acceptance of the new Terms. We will notify users of material changes via email or in-app notification.

Mahl is an AI-assisted paint colour matching and studio planning application for painters. The Service includes:

• AI colour matching from reference photos against the user's personal paint inventory
• Session Planner with AI-powered zone detection
• Mother Palette extraction and mixing recipe generation
• AI-assisted progress photo critique
• Paint inventory management and wishlist
• Mix Studio colour workspace
• Project management and progress tracking

The Service is provided on a freemium basis. Free accounts are subject to usage limits described on our website. Mahl Pro subscribers have access to expanded features and higher limits as described at the time of purchase.

• You must be at least 13 years of age to use the Service (16 in the EEA)
• If you are under 18, you represent that you have your parent or guardian's permission to use the Service
• You must provide accurate and complete information when creating an account
• One person may not maintain more than one free account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@mahl.app if you suspect any unauthorised use of your account. We are not liable for any loss resulting from unauthorised use of your account where you have not taken reasonable steps to protect your credentials.

Free tier

Mahl's free tier is available without payment and is subject to the feature limits published on our website at the time of use. We reserve the right to modify free tier limits with reasonable notice.

Mahl Pro — web subscriptions

Mahl Pro web subscriptions are processed by Paddle as merchant of record. By subscribing you agree to Paddle's terms of service in addition to these Terms. Subscription fees are charged at the rates displayed at the time of purchase.

• Monthly subscriptions: charged each month on the date you subscribed
• Annual subscriptions: charged once per year on the date you subscribed
• Prices are listed in AUD and may be converted to your local currency by your payment provider
• We reserve the right to change subscription pricing with at least 30 days' notice to existing subscribers

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Mahl Pro — iOS App Store subscriptions

If you subscribe through the iOS App Store, your subscription is subject to Apple's payment terms and is processed by Apple. Apple's standard subscription terms apply including their cancellation and refund policies. We have no control over and no access to payments processed through Apple.

Free trial (Mahl Pro Monthly)

Mahl Pro Monthly includes a 7-day free trial. A valid payment method is required to start the trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid monthly subscription at A$9 per month (or the price displayed at sign-up), and your card will be charged on day 8. You may cancel at any time during the trial from your profile to avoid being charged. Annual subscriptions and the Free tier do not include a trial.

You may cancel your Mahl Pro subscription at any time. Cancellation instructions depend on how you subscribed:

• Web subscriptions via Paddle: cancel from your account Settings page or by contacting hello@mahl.app
• iOS App Store subscriptions: cancel through your Apple ID subscription settings at Settings > Apple ID > Subscriptions

Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that date. We do not provide prorated refunds for partial billing periods except where required by law (see Refund Policy). To avoid being charged at the end of a free trial, cancel before the trial end date shown in your profile.

Your content

You retain ownership of all content you upload to Mahl, including reference photos, notes, and project data ('User Content'). By uploading User Content, you grant us a limited, non-exclusive licence to process and display that content solely for the purpose of providing the Service to you.

Your responsibilities

• You must have the right to upload any content you submit, including ownership or appropriate licence for any reference photos
• You must not upload content that infringes third-party intellectual property rights
• You must not upload content that is illegal, harmful, threatening, abusive, or violates any applicable law
• You must not upload images of private individuals without their consent
• You must not use the Service for any commercial purpose not expressly permitted by these Terms

AI-generated content

Mixing recipes, critiques, and other content generated by Mahl's AI features are provided for guidance only. They are based on AI processing of your data and should not be relied upon as professional advice. Results may vary and are not guaranteed to be accurate.

You agree not to:

• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Use automated tools to scrape, crawl, or excessively query the Service
• Attempt to circumvent subscription limits or access controls
• Use the Service in any way that could damage, disable, or impair its operation
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Service to transmit spam, malware, or any harmful code
• Attempt to gain unauthorised access to any other user's account or data

The Mahl name, logo, wordmark, app design, colour scheme, and all original content created by us (excluding User Content) are our intellectual property or that of our licensors. You may not reproduce, distribute, or create derivative works from our intellectual property without our express written permission.

The 'Mahl.' wordmark and brand identity are protected under Australian common law and are the subject of a pending trademark application with IP Australia.

The Service integrates with third-party services including Anthropic (AI processing), Supabase (database), and Paddle (payments). We are not responsible for the practices, availability, or content of these third-party services. Their respective terms of service and privacy policies apply to your use of their services as part of Mahl.

THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure
• AI-generated colour matches or critiques will be accurate or suitable for your particular use
• The Service will meet your specific requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR AUD $100, WHICHEVER IS GREATER.

NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY RIGHTS YOU MAY HAVE UNDER THE AUSTRALIAN CONSUMER LAW OR OTHER APPLICABLE CONSUMER PROTECTION LEGISLATION THAT CANNOT BE EXCLUDED BY AGREEMENT.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your subscription and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. For minor failures with the service, we are entitled to fix the problem within a reasonable time. If we do not, you have the right to cancel and obtain a refund for the unused portion.

We reserve the right to suspend or terminate your account at any time if you breach these Terms. We will provide notice where reasonably practicable. You may delete your account at any time from the app settings or by contacting hello@mahl.app.

On termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitation of liability.

These Terms are governed by the laws of South Australia, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of South Australia for any disputes arising from these Terms or the Service. If you are a consumer in the EEA, you retain the right to bring proceedings in your country of residence.
